Krieg DeVault is pleased to announce the promotions of three Associates to Senior Associates – Nicholas J. Anderson, Nicole M. Keith and Brandon W. Shirley. Prior to Senior Associate positions with the firm, all served as Associates with Krieg DeVault in their respective practices.

ABOUT THE SENIOR ASSOCIATES

Nicholas J. Anderson (Carmel Office) - Nicholas J. Anderson is an Associate in the firm's Business, Acquisitions & Securities, Tax, and Public and Municipal Finance Practice Groups. He focuses his practice in representing businesses with general corporate, federal tax, and financing matters. 

Prior to joining Krieg DeVault, Mr. Anderson was a Tax Associate for Kutak Rock LLP where he focused his practice in broad-based national tax practice involving corporate and partnership tax planning, taxation of financial products, private equity, lease financing, public finance, real estate and exempt organizations. He also has experience in tax credit transactions, including New Markets Tax Credit, Low Income Housing Tax Credit, and EB-5 transactions.

Nicole M. Keith (Merrillville Office) - Nicole M. Keith is a member of the firm’s Litigation Practice Group, where she focuses her expertise in civil litigation. She represents clients dealing with a wide variety of legal issues including the defense of hospitals and physicians in medical malpractice and premises liability cases and representation of health care organizations and businesses in litigation matters. 

With a background in civil litigation and insurance defense, Ms. Keith has represented insureds, insurance companies and corporations.  She also has experience handling various cases in the practice areas of nursing home negligence, employment law, probate and estate planning, contracts, family law, real estate, personal injury, and criminal law. Prior to joining Krieg DeVault, she worked for Kopka, Pinkus & Dolin as an Associate Attorney and Rubino, Ruman, Crosmer & Polen LLC as an Associate Attorney and Law Clerk.  During law school, she worked for the Valparaiso University Sports Law Clinic as a Case Manager, Clinic Member, and Arbitration Participant, in which she represented individuals involved with amateur sports that had legal issues relating to matters arising from their sports-related role.  Ms. Keith has significant courtroom experience including regularly appearing and advocating on behalf of clients in court proceedings such as jury trials, bench trials, motion practice hearings and court mandated conferences, arbitrations and mediations.

Brandon W. Shirley (Indianapolis Office) - Brandon W. Shirley is a member of the firm’s Health Care Practice Group. His practice areas include Medicare and Medicaid reimbursement,  government audits, disciplinary sanctions involving Medicare and Medicaid enrolled providers, state surveys and corrective action plans, federal and state regulatory compliance, contract reviews, and Medicaid pharmacy matters.

Prior to joining Krieg DeVault, Mr. Shirley acquired government and regulatory compliance experience as the deputy general counsel and as a staff attorney with the Indiana Family and Social Services Administration. As a result, Mr. Shirley has significant experience responding to government audits and regulatory actions against all Medicaid provider types including prosecuting administrative appeals. Mr. Shirley understands the complexities of Medicaid and Medicaid managed care reimbursement and handles many related issues and transactions. Mr. Shirley has successfully developed corrective action plans for hospitals and other health systems in response to findings involving life-safety conditions and clinical practices. Mr. Shirley worked closely with the State and Federal prosecutors on matters relating to Medicaid fraud and abuse as a government attorney. He currently advises clients on matters relating to Medicaid fraud and abuse, including compliance with the Anti-Kickback Statute and Stark physician referral laws. Mr. Shirley regularly counsels clients on matters relating to Medicaid and Medicaid managed care pharmacy reimbursement, compliance issues, audits, and adverse determinations. Mr. Shirley drafts and reviews contracts for hospitals, health systems, and independent practice groups involving matters of all types. He played a key role in drafting the laws and rules necessary to implement and support major healthcare reforms and understands Medicaid assistance and waiver programs in Indiana. 

Mr. Shirley also advises on public disclosure requirements including compliance with open door and open record laws and has experience responding to inquiries from the Indiana Public Access Counselor. Mr. Shirley regularly reviews and advises on matters relating to State and Federal health care legislation and government affairs matters.
