William Barkimer counsels clients and litigates disputes in a wide range of civil and commercial litigation matters. Particular areas of focus includes contractual disputes, shareholder disputes, banking liability, probate litigation, tort law, real estate disputes, and intellectual property. Mr. Barkimer has litigated cases involving breach of contract, fraud, constructive fraud, conversion, wage and compensation claims, misappropriation of trade secrets, trademark infringement, employment law, discrimination issues, covenants not to compete, negligence, product liability, shareholder disputes, commercial evictions, defamation, and creditors' rights. Mr. Barkimer has served as counsel in numerous jury trials, bench trials, hearings, mediation, and arbitration in both state and federal courts across the State of Indiana. In addition, Mr. Barkimer has experience handling complex electronic discovery issues, collection matters, and administrative matters.

Representative Experience

  • Represented individuals and small businesses in various areas of law including contractual disputes, shareholder disputes, banking liability, probate litigation, personal and business torts, real estate disputes, insurance litigation, and intellectual property.   
  • Served as counsel for both property owners and condemning authority in numerous condemnation matters, including cases taken all the way through jury trial.
  • Served as counsel on behalf of health care organization in an arbitration claiming breach of a medical management services agreement.
  • Served as counsel on behalf of manufacturer of roof materials in bench trial relating to claims of breach of warranty.
  • Served as counsel on behalf of various state court judges in mandate action against local county government demanding higher wages for court staff.
  • Served as counsel for various financial institutions in litigation matters relating to institutions’ role in regard to various estate planning documents. 
  • Served as counsel in various shareholder disputes and limited liability member disputes, representing both the majority and minority side.
  • Litigated cases throughout the state in both federal and state court.
  • Responsible for developing and managing a growing collections practice with clients including medical providers, financial institutions, and utility companies.
