Kristen L. Gentry
Kristen Gentry’s practice is concentrated in the areas of health law and health and welfare employee benefits. In health care, Ms. Gentry represents a variety of health care providers and governmental entities, in areas including Medicare and Medicaid program reimbursement, HIPAA Privacy and Security compliance, STARK and Anti-Kickback compliance, contracting, 340B drug pricing, and various other regulatory issues.
In the employee benefits area, Ms. Gentry concentrates her practice on health and welfare benefit plan issues and represents employers in all aspects of regulatory compliance, including HIPAA nondiscrimination, privacy and security rules; COBRA continuation coverage rules; ERISA mandates; Medicare Secondary Payer requirements; nondiscrimination rules; Code Section 125 plans; health reimbursement accounts and health savings accounts.
Representative Experience
Health Care:
- Representing providers regarding general Medicaid reimbursement issues, including review of payment programs, appeals to managed care organizations and appeals of audit findings
- Represent governmental and other providers regarding State Medicaid supplemental, disproportionate share and administrative claiming payment programs
- Structuring of permissible intergovernmental transfer of funds ("IGTs")
- Preparation, submission and negotiation of Medicare Part A Cost Report Appeals to the PRRB
- Requesting favorable Advisory Opinions from the Department of Health and Human Services, Office of Inspector General
- Assisting providers with various other issues they have with State and Federal health care agencies
Employee Benefits:
- Designing, training, assisting with implementation of, and compliance with HIPAA Privacy and Security policies for self-funded health plans, health care flexible spending accounts and fully-insured plans
- Designing, structuring, compliance with and documentation of health plans, including drafting of plan documents and summary plan descriptions, amendments and termination of plans
- Performing non-discrimination testing on health and welfare benefit plans
- Designing, structuring, compliance with and documentation of Code Section 125 Cafeteria plans, including drafting of premium only plans, health care flexible spending accounts, dependent care flexible spending accounts, State-mandate requirements (i.e. Massachusetts 125 plan requirements for otherwise excluded employees), and the inclusion of and compliance with health savings accounts
- Issues concerning COBRA, ERISA, Medicare Part D, Medicare Secondary Payer, HIPAA portability, and Wellness programs compliance, implementation and issues
