Jason A. Houdek

Jason Houdek was born in Geneva, Switzerland and came of age in Indianapolis, Indiana.  Mr. Houdek focuses his practice on intellectual property matters.  He has experience in patent litigation,  trade secret litigation, trademark litigation, patent reexamination proceedings, counseling clients on right to practice and patent clearance issues, and in drafting and prosecuting patent applications.  Mr. Houdek's practice has spanned a number of technologies including clean diesel technologies, gas turbine engine technologies, control systems, ophthalmic sensor systems, cryptographic security algorithms, bio-data systems, medical devices, tissue engineering, and satellite television systems, among others.   Mr. Houdek also has experience in obtaining trademarks and copyrights, and in agreement drafting and licensing negotiation.

Representative Experience

• Mr. Houdek has prepared patent reexamination requests on behalf of a client accused of infringing a multi-patent portfolio including over 100 patent claims, and facing a multi-million dollar liability claim.   The U.S. Patent & Trademark Office ordered reexamination of the patents and ultimately rejected nearly every claim asserted against the client     
• Mr. Houdek has counseled clients in designing around complex multi-patent portfolios to minimize the risk associated with multi-million dollar product offerings
• Mr. Houdek was a member of a trial team that obtained a jury verdict of patent infringement on behalf of a client in a case involving tissue engineering technology
• Mr. Houdek has advised clients in pre-litigation strategy for defending against patent infringement assertions by non-practicing patent litigants sometimes referred to as patent trolls
• Mr. Houdek has assisted clients in determining the value and risk of technology that they wish to purchase by helping them understand the protection that exists or is available for the technology,  and developing strategic negotiating positions based upon these assessments
• Mr. Houdek has successfully represented clients in trade secret litigation involving damages of several million dollars
• Mr. Houdek has obtained copyright registrations for a client's software which required investigating a multi-author, multi-company series of transactions
