Greg A. Small
Greg Small’s practice emphasizes corporate and commercial litigation. Even though his practice encompasses a multitude of areas, Mr. Small devotes much of his time to the areas of financial institutions litigation, product liability defense, class action defense, eminent domain/condemnation and appellate practice. Mr. Small has both federal and state trial experience as well as arbitration experience under the American Arbitration Association. Mr. Small has extensive appellate practice experience, including amicus filings, before the Seventh Circuit, Indiana Supreme Court and Indiana Court of Appeals. Mr Small's federal court experience and knowledge of the local rules have enabled him to effectively serve as local counsel. Mr. Small is also well versed in the areas of electronic discovery and data management.
Representative Experience
- Obtained judgment on the pleadings in favor of financial institution in class action brought by customers after the financial institution's computers were maliciously intruded by unauthorized third parties, which was an issue of first impression in the Seventh Circuit. Pisciotta v. Old Nat. Bancorp, 499 F.3d 629 (7th Cir. 2007).
- Obtained summary judgment on behalf of financial institution in multi-million dollar breach of contract claim filed by banking consultant. John M. Floyd & Assocs., Inc. v. STAR Fin. Bank, 2005 WL 1660979 (N.E. Ind. 2005), reaffirmed at John M. Floyd & Assocs., Inc. v. STAR Fin. Bank, 489 F.3d 852 (7th Cir. 2007).
- Filed amicus brief in a case in which the Indiana Court of Appeals reversed the trial court's award of damages and established a limitation on damages for medical malpractice claims. Indiana Patients Compensation Fund v. Butcher, 863 N.E.2d 11 (Ind. Ct. App. 2007).
- Participated in appeal in which the Indiana Supreme Court established new law for the protection of trade secrets from disclosure during the discovery process. Bridgestone Americas Holding, Inc., et al. v. Mayberry, 878 NE2d 189 (Ind. 2007).
