Education and School Law


With a team of more than 10 attorneys experienced in education and school law, including former teachers, education professionals, school board members and university trustees, Krieg DeVault can address the complexity of issues that arise in the primary, secondary, and post-secondary education sectors.

At the university, college and other post-secondary levels, our attorneys use their practice knowledge in the areas of education financing, exempt organizations, tax-exempt financing, technology transfers, internet and e-commerce platforms, and governmental affairs to find solutions for the myriad of issues arising in these dynamic and challenging times. We have represented our clients’ interests before state and federal departments of education and other administrative, legislative and agency levels. We assist our higher education clients with corporate restructuring, real estate, environmental work, risk management, finance and incentives, employment law and other areas of need. Our clients include student lending and guarantor sources, universities and colleges that recruit at the national, regional and state levels, post-secondary technical and vocational schools, distance and on-line education providers, education foundations and internet-based support resources.

Krieg DeVault also strives to partner with educators serving Indiana’s primary and secondary schools in public and private settings. Our school law services are utilized by public school corporations, private schools, and charter schools as each meets the educational needs and other challenges of their students, staff, and constituents. Our attorneys bring a depth of legal knowledge as well as practical experience in the areas of state and federal education laws, school governance, and school finance, to name a few. In the student life and discipline arena, our attorneys assist with issues including settlement and tuition, FERPA, free speech, student transfer and eligibility rules as well as suspension, expulsion, and due process hearings. We also represent education-based professional associations whose members seek advice on a wide variety of legal issues facing schools and students today. We have provided counsel on a successful school referendum to increase funding from property taxes and on obtaining reimbursement from Medicaid/CHIP funding sources.

Our attorneys are also well-versed in the complexities facing Academic Medical Centers and research facilities. We have assisted clients in compliance with the Human Research Protections and Institutional Review Board (IRB) process. Firm attorneys have also dealt with the rapidly changing area of reimbursement for Resident training academic time. We have advised Campus Health Clinics, including Mental Health providers, on release of information and other compliance matters.

Many of our attorneys have served or currently serve on the boards of various educational institutions and on public school boards which allow us to apply first hand knowledge and experience in designing solutions to the challenges confronting many public and private academic institutions.
