Litigation

Krieg DeVault is well known for the strength of its civil litigation practice. The Litigation Practice Group is staffed by seasoned trial attorneys whose background and experience cover all the major practice areas in the firm. We represent local, regional, national and international companies and individuals in litigation matters in both federal and state courts. Similarly, we assist clients in dealing with various federal, state and local administrative agencies, including representing clients before administrative tribunals. Members of the Litigation Practice Group are experienced in handling arbitration and mediation proceedings. Several members are also trained arbitrators and mediators.

The members of the Litigation Practice Group are experienced in handling complex and sophisticated litigation, as well as cases that are smaller in scope. We work closely with our clients to determine the most practical and economically-feasible method of resolving disputes, consistent with the clients’ business goals. The Litigation Practice Group can represent clients efficiently and cost-effectively by utilizing the Firm’s experienced support staff who streamline the stages necessary to prepare cases for trial or alternative dispute resolution.

The attorneys in the Litigation Practice Group have experience in many types of litigation including:

  • Corporate litigation arising out of mergers, acquisitions and takeovers;
  • Resolution of environmental controversies with local, state and federal agencies;
  • Disputes regarding enforcement or infringement of intellectual property rights and computer technology, the disclosure of confidential information or misappropriation of trade secrets and trademark infringement;
  • Disputes involving physicians, hospitals and other health care providers, practice management organizations and governmental regulations of health care services;
  • Defense of medical malpractice claims;
  • Qui Tam actions;
  • General commercial disputes;
  • Corporate litigation initiated by shareholders individually and in derivative actions;
  • Complex product liability cases involving products such as air bags, air springs, roofing materials, tires, cranes, chemicals, tobacco, machinery, and products alleged to contain asbestos;

  • Suits based upon federal and state securities laws and regulations;
  • Claims brought under federal and state RICO and similar statutes;
  • Tax litigation in both federal and state tribunals;
  • Defending ERISA actions under the Multi-Employer Pension Plan Amendments Act; and
  • Toxic tort cases and cases involving environmental disputes.

The Litigation Practice Group also has extensive experience in the area of appellatepractice and procedure. Our attorneys have represented clients before state andfederal courts of appeal, including the U.S. Supreme Court. The scope of issuesaddressed include appellate review of decisions of various state and federal agencies,dispositive rulings entered by trial courts, the grant or denial of injunctive relief, Daubert motions, and jury trial verdicts.
