Mr. Fearnow is a graduate of the
University of Indianapolis and Indiana University School of Law. He concentrates his practice in the areas of health care and government relations. His experience includes lead or co-counsel duties in more than forty jury trials in state and federal courts and arguments on behalf of health care providers before the Indiana Court of Appeals and Seventh Circuit Court of Appeals. He began his legal career in 1981 with the Marion County (Indianapolis, Indiana) Prosecutor's Office, where he served as a deputy prosecutor responsible for trying numerous major felonies. This experience, combined with his expertise in health care litigation, has enabled him to represent effectively health care providers who have been prosecuted or have become the focus of state or federal audits or investigations. Mr. Fearnow worked in various capacities with the Indiana General Assembly from 1983 to 1998, including five sessions as Chief Counsel to the Senate from 1993 to 1998. From 1985 to 1987, Mr. Fearnow served as General Counsel and Vice President of Government Relations for the Indiana Health Care Association. As the Association's legislative director, he lobbied the Indiana General Assembly successfully on a number of issues important to nursing facilities. During his tenure, the Indiana General Assembly extended the State's Certificate of Need Program and allowed nursing facilities to participate as providers under the Indiana Medical Malpractice Statute. In private practice, he has advised physicians, nursing facilities, home health agencies, ambulatory surgery centers, transportation providers, and many other health care companies on a variety of regulatory issues. At the General Assembly, he has assisted a broad range of clients on legislative matters, including matters affecting medical stop loss insurance carriers, gaming laws, and the interests of Indiana prosecuting attorneys.
