Kristen Gentry's practice is concentrated in the areas of health law and health and welfare benefit plans. In health care, Ms. Gentry represents a variety of health care providers and governmental entities, in areas including Medicare and Medicaid program reimbursement, HIPAA Privacy and Security compliance, fraud and abuse, contracting, 340B drug pricing, and various other regulatory issues.  Ms. Gentry's experience with Medicaid reimbursement includes representing physicians, psychiatrists, HSPPs, public and private hospitals, community mental health centers, and psychiatric hospitals with general Medicaid reimbursement issues, audits, and with the Medicaid supplemental, disproportionate share and administrative claiming programs.  She has also provided assistance to hospitals in preparing Medicare Part A Cost Report Appeals to the PRRB, in seeking favorable Advisory Opinions from the Department of Health and Human Services, Office of Inspector General, and assisting with various other issues providers have with State and Federal health care agencies.

 

In the Employee benefits area, Ms. Gentry concentrates her practice on health and welfare benefit plan issues and represents employers in all aspects of regulatory compliance, including:

 

n        designing, training, assisting with implementation of, and compliance with HIPPA Privacy and Security policies for self-funded health plans, health care flexible spending accounts and fully-insured plans;

n        designing, structuring, compliance with and documentation of health plans, including drafting of plan documents and summary plan descriptions, amendments and termination of plans;

n        designing, structuring, compliance with and documentation of Code Section 125 Cafeteria plans, including drafting of premium only plans, health care flexible spending accounts, dependent care flexible spending accounts, State-mandate requirements (i.e. Massachusetts 125 plan requirements for otherwise excluded employees), and the inclusion of and compliance with health savings accounts; and

n        issues concerning COBRA, ERISA, Medicare Part D, Medicare Secondary Payer, HIPAA portability, and Wellness programs compliance, implementation and issues.

 

Ms. Gentry graduated from Indiana University Bloomington in 1998 with a degree in Health Administration.  She then completed her law degree at Indiana University School of Law Indianapolis in 2002 and was admitted to the Indiana bar in 2002.
